Privacy Statement

SmartWhere, LLC (“smartwhere”) is committed to protecting the privacy of your information. This Privacy Statement describes Smartwhere’s Website privacy practices.

Smartwhere is a cloud-based Proximity Technology management service (the “Smartwhere Service”).


1. Websites Covered

This Privacy Statement covers the information practices of the Smartwhere website and may contain links to other website that are not controlled by Smartwhere. Smartwhere is not responsible for the information practices or the content of such other website. Smartwhere encourages you to review the privacy statement of other websites to understand their information practices.


2. Information Collected

Smartwhere collects information from individuals who visit Smartwhere (“Visitors”) and individuals who register to use the Smartwhere Service (“Users”).

When expressing an interest in obtaining additional information about the Smartwhere Service or registering to use the Smartwhere Service, Smartwhere requires you to provide personal contact information, such as name and email address (“Required Contact Information”).

If you elect to purchase products or services from Smartwhere that require payment, Smartwhere requires you to provide financial qualification and billing information, such as billing name and credit card number (“Billing Information”). Please note that Smartwhere uses a third-party service provider to manage credit card processing, and Billing Information is not stored by Smartwhere.

Smartwhere may also ask you to provide additional information to provide a better service, such as number of employees or industry (“Optional Information”).

Required Contact Information, Billing Information, and Optional Information are referred to collectively as “Data About Smartwhere Users.”

As you navigate the Smartwhere Website, Smartwhere may also collect information through the use of commonly-used information-gathering tools, such as cookies and Web beacons (“Website Navigational Information”). Website Navigational Information includes standard information from your Web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on the Smartwhere Website and in your use of the Smartwhere Service (such as the Web pages viewed and the links clicked). Section 11 Your Data and the Smartwhere Service describes our privacy practices with respect to information you submit to the Smartwhere Service.


3. Use of Information Collected

Smartwhere uses Data About Smartwhere Users to perform the services requested. For example, if you fill out a “Signup For Free” form, Smartwhere will use the information provided to contact you about your interest in the Smartwhere Service.

Smartwhere may also use Data About Smartwhere Users for marketing purposes. For example, Smartwhere may use the information you provide to contact you to further discuss your interest in Smartwhere and to send you information regarding Smartwhere and its partners, such as information about promotions or events.

Additionally, Smartwhere may use Data About Smartwhere Users to customize your experience in the Smartwhere Service. For example, when you login to your account, Smartwhere may display the names of other Users you are working with.

Smartwhere uses a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use Billing Information except for the sole purpose of credit card processing on the Smartwhere’s behalf.

Smartwhere uses Website Navigational Information to operate and improve Smartwhere’s Website and the Smartwhere Service. Smartwhere may also use Website Navigational Information alone or in combination with Data About Smartwhere Users to provide personalized information about Smartwhere.


4. Website Navigational Information

Smartwhere uses commonly-used information gathering tools, such as cookies and Web beacons, to collect information as you navigate the Smartwhere Website and the Smartwhere Service (“Website Navigational Information”). This section describes the type of Website Navigational Information that may be collected on the Smartwhere Website and how this information may be used.

Cookies

Smartwhere uses cookies to make interactions with the Smartwhere Website easy and meaningful. When you visit the Smartwhere Website, Smartwhere’s servers send a cookie to your computer. Standing alone, cookies do not personally identify you; they merely recognize your Web browser. Unless you choose to identify yourself to Smartwhere, either by responding to a promotional offer or by filling out a Web form (such as a “Signup For Free” Web form), you remain anonymous to Smartwhere.

Smartwhere uses cookies that are session-based and persistent-based. Session cookies exist only during one session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you close your browser or turn off your computer.

If you have chosen to identify yourself to Smartwhere, Smartwhere uses session cookies containing encrypted information to allow Smartwhere to uniquely identify you. Each time you log into the Smartwhere Service, a session cookie containing an encrypted, unique identifier that is tied to your account is placed in your browser. These session cookies allow Smartwhere to uniquely identify you when you are logged into the Smartwhere Service and to process your online transactions and requests. Session cookies are required to use the Smartwhere Service.

Smartwhere uses persistent cookies that only Smartwhere can read and use to identify browsers that have previously visited the Smartwhere Website. When you register to use the Smartwhere Service or provide Smartwhere with personal information, a unique identifier is assigned to you. This unique identifier is associated with a persistent cookie that Smartwhere places on your Web browser. Smartwhere is especially careful about the security and confidentiality of the information stored in persistent cookies. For example, Smartwhere does not store passwords in persistent cookies. If you disable your Web browser’s ability to accept cookies, you will be able to navigate the Smartwhere Website, but you will not be able to successfully use the Smartwhere Service.Smartwhere may use information from session and persistent cookies in combination with Data About Smartwhere Users to provide you with information about Smartwhere and its products and services.

Web Beacons

Smartwhere uses Web beacons alone or in conjunction with cookies to compile information about Users and Visitors’ usage of Smartwhere and interaction with emails from Smartwhere. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular Website tied to the Web beacon, and a description of a Website tied to the Web beacon. For example, Smartwhere may place Web beacons in marketing emails that notify Smartwhere when you click on a link in the email that directs you to one of Smartwhere’s Websites. Smartwhere uses Web beacons to operate and improve Smartwhere and email communications.

Smartwhere may use information from Web beacons in combination with Data About Smartwhere Users to provide you with information about Smartwhere and its products and services.

Flash Cookies

Smartwhere and other third parties use local shared objects, also known as Flash cookies, to store your preferences or display content based upon what you view on our site to personalize your visit. Third parties, with whom Smartwhere partners to provide certain features on our site or to display advertising based upon your Web browsing activity, use Flash cookies to collect and store information.

IP Addresses and URLs

When you visit the Smartwhere Website, Smartwhere collects your Internet Protocol (“IP”) addresses to track and aggregate non-personal information. For example, Smartwhere uses IP addresses to monitor the regions from which Customers and Visitors navigate the Smartwhere Website.

Additionally, due to communications standards on the Internet, when you visit the Smartwhere Website, Smartwhere automatically receives the URL of the site from which you came and the site to which you are going when you leave the Smartwhere Website.

Third Party Cookies

From time-to-time, Smartwhere engages third parties to track and analyze usage and volume statistical information from individuals who visit Smartwhere. Smartwhere may also use other third-party cookies to track the performance of Company advertisements. The information provided to third parties does not include personal information, but this information may be re-associated with personal information after Smartwhere receives it.

Smartwhere also contracts with third-party advertising networks that collect IP addresses and other Website Navigational Information on the Smartwhere Website and emails and on third-party Websites. Ad networks follow your online activities over time by collecting Website Navigational Information through automated means, including through the use of cookies. They use this information to provide advertisements about products and services tailored to your interests. You may see these advertisements on other Websites. 5. Tracking and Analysis in the Smartwhere Service

Smartwhere may track and analyze how Users use the Smartwhere Service for the purposes of helping Smartwhere improve the Smartwhere Service. Smartwhere may engage with service providers to assist us in such tracking and analysis. When Smartwhere engages with providers to assist in such tracking and analysis, we will make usage statistics anonymous so as to not disclose your identity to such service providers.

Additionally, in the future, Smartwhere may display special partner offers that may be of interest to you within the Smartwhere Service. Smartwhere does not share your information with third-party advertisers unless you expressly consent to such sharing.


6. Public Forums and Customer Testimonials

Smartwhere may provide bulletin boards, blogs, or chat rooms on the Smartwhere Website. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. Smartwhere is not responsible for the personal information you choose to submit in these forums. To request removal of your personal information from our blog or community forum, contact us at [privacy@smartwhere.com]. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

Smartwhere posts a list of Customers and testimonials on Smartwhere’s Websites that contain information such as Customer names and titles. Smartwhere obtains the consent of each Customer prior to posting any information on such a list or posting testimonials.


7. Sharing of Information Collected

Service Providers

Smartwhere may share Data About Smartwhere Users with Smartwhere’s service providers so that these service providers can contact Users and Visitors who have provided contact information on our behalf. Smartwhere may also share Data About Smartwhere Users with Smartwhere’s service providers to ensure the quality of information provided. Smartwhere does not share, sell, rent, or trade any information provided from Smartwhere Users or Visitors with third parties for their promotional purposes.

Smartwhere uses a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use Billing Information except for the sole purpose of credit card processing on Smartwhere’s behalf.

Partnering With Other Organizations to Offer Combined Services

Smartwhere may partner with other online services to give you the combined results of both services. Whenever we offer such combined services, it will be your choice to make use of the combined services or not. In these cases, your personal information will only be passed from Smartwhere to the partner if you choose to use the combined service.

Legal Disclaimer

Smartwhere reserves the right to use or disclose information provided if required by law or if Smartwhere reasonably believes that use or disclosure is necessary to protect Smartwhere’s rights and/or to comply with a judicial proceeding, court order, or legal process.


8. International Transfer of Information Collected

To facilitate Smartwhere’s global operations, Smartwhere may transfer and access Data About Smartwhere Users from around the world, including the United States. This Privacy Statement shall apply even if Smartwhere transfers Data About Smartwhere Users to other countries.


9. Communications Preferences

Smartwhere offers Customers and Visitors who provide contact information a means to choose how Smartwhere uses the information provided. You may manage your receipt of marketing and non-transactional communications by emailing help@smartwhere.com or by clicking on the “unsubscribe” link located on the bottom of Smartwhere’s marketing emails. Customers cannot opt out of receiving transactional emails related to their account with Smartwhere or the Smartwhere Service.


10. Correcting and Updating Information

Users may update or change their registration information by emailing help@smartwhere.com. Requests to access, change, or delete your information will be handled within 30 days.

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services contact us at help@smartwhere.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.


11. Your Data Submitted to the Smartwhere Service

Smartwhere Users may electronically submit data or information to the Smartwhere Service for hosting and processing purposes (“Your Data”). Except as described in this Smartwhere Privacy Statement, Smartwhere will not review, share, distribute, or reference any of Your Data except to provide the Smartwhere Service (including as described above in Section 5. Tracking and Analysis in the Smartwhere Service), to prevent or respond to technical or service problems, at a User’s request in connection with a support matter, or as may be required by law.


12. Security

Smartwhere utilizes appropriate administrative, technical, and physical safeguards to protect Data Smartwhere Users and Your Data. Secure Socket Layer (SSL) technology protects Smartwhere User Data using both sever authentication and data encryption. These technologies help provide safety and security for Smartwhere User Data and help to restrict its availability to the User to whom the information belongs and those to whom the User has granted access. Smartwhere also implements an advanced security method based on dynamic data and encoded session identifications, and Smartwhere hosts its Websites in a secure server environment that uses firewalls and other advanced technology designed to prevent interference or access from outside intruders. Users are responsible for maintaining the security and confidentiality of their Smartwhere usernames and passwords.


13. Personal Information of Children

Smartwhere is not intended for children under the age of 13 and Smartwhere does not knowingly collect any personal information from such children. As indicated in the User Agreement, children under the age of 13 should not use the Smartwhere Website or the Smartwhere Service at any time. In the event that Smartwhere learns that it has inadvertently gathered personal information from children under the age of 13 via the Smartwhere Website or the Smartwhere Service, Smartwhere will make reasonable efforts to promptly erase such information from our records.


14. Changes to this Privacy Statement

Smartwhere reserves the right to change this Privacy Statement. Smartwhere will provide notification of the material changes to this Privacy Statement through Smartwhere’s Websites at least thirty (30) business days prior to the change taking effect.
